Spouse : A spouse visa is for those who have been legally married before making an application

If you are legally married to an Australian sponsor then you are eligible to apply for the ‘Spouse’ visa, with the ‘applicant being the person who needs the visa and the Australian husband or wife being the ‘spouse’.

The person acting as the sponsor may be an Australian Citizen/Permanent resident or may also be an eligible permanent resident. These applications may take anything from 2-8 months depending on the circumstances. Applications are to be processed at the DIAC visa office.

Evidence that can be presented to show that the couples are in genuine spousal relationships are things like making sure family, friends and neighbours are aware of the relationship and proof of living together and communication when apart.

After being accepted for this visa another application may be lodged for a full PR Australian spouse visa (Australian visa for my husband/wife) after a 2 year provisional permanent resident visa.

De Facto Partner:

A De-facto partner visa is for those couples who can complete their assessment with paper evidence proving that they have lived together in the same household for at least 12 months. This visa is for couples who require an Australian partner visa for common law spouses.

Prospective Spouse: This visa is an option for those couples who plan to marry within a year.

Otherwise known as an Australian fiancée visa. This visa can take anywhere between 2-7 months to apply for and once it is granted you will have 9 months to register your marriage within Australia. See ‘Spouse’ visa above for further information.
